Maritime - Boating Injuries

Each year hundreds of people die in boating accidents and thousands suffer serious personal injury. Recreational fishermen, water skiers, and people just out on the water to have fun - then tragedy strikes.

Boating accidents -- as opposed to commercial vessels -- can fall under the Jones Act and U.S. General Maritime Law when the vessel's "unseaworthiness" causes the injury or death.

Boating Injuries

Most boating injuries and deaths are preventable . Drowning - the #1 cause of boating fatalities - could have been prevented in most cases by simply wearing a life jacket. But all too many pleasure boat owners and operators fail to make life preservers available to their passengers and guests. When boat owners/operators neglect safety procedures such as life vests; night running lights, wake laws, excessive speed, and proper boating safety operation - they can be held liable for the injuries that result from such negligence.

"A Drunk Man is Soon a Dead Man"

The United States Coast Guard reports that alcohol is involved in over a third (1/3) of all boat deaths. Again, drunk boat operators can be held responsible for the injuries their negligence causes.

Boating

While operators and guests aboard recreational pleasure boats are not "Seamen" and therefore usually not covered by the Jones Act, Maritime Law does play an important role in determining boating accident claims.

Cruise Ship Passengers

Last year more than three million Americans went on cruises. Some suffered serious injuries. Cruise ship passengers get hurt by:

  • Stomach ailments and viruses caused by contaminated food.
  • Accidents on shore excursions, sightseeing and in ports.
  • Slips and Falls on slippery surfaces, ladders, stairways, and decks.
  • Fires and collisions at sea.
